Reassessing Public Disclosure of Short Positions in Europe
The SBAI supports the European Commission's ambition to deepen and strengthen European capital markets and enhance their international competitiveness.
Recent discussions with international institutional investors highlighted questions regarding the operation of the EU public disclosure regime for short positions. While regulators already receive information on significant short positions through the existing reporting framework, the EU remains one of the few major jurisdictions to require the public disclosure of individual short positions.
As policymakers seek to strengthen Europe's capital markets, it is appropriate to consider whether the current public disclosure regime is achieving its intended objectives, or whether it may create unintended consequences for investors and market functioning.
